1. Agreement to Terms

By accessing or using DishiDash ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

DishiDash is a marketplace platform that connects restaurants with independent dishwashing service providers ("Dishies"). We provide a platform for matching restaurants with available dishwashing services, but we are not a party to any service agreement between restaurants and Dishies.

2. Description of Service

DishiDash is a mobile marketplace application that enables restaurants to post short-notice dishwashing jobs and connects them with nearby Dishies who can accept and complete these jobs. The Platform facilitates:

  • Job posting and matching services

  • In-app communication between restaurants and Dishies

  • Payment processing services

  • Location-based job discovery

3. User Accounts and Registration

To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Roles

Restaurants

As a restaurant user, you may post dishwashing jobs, specify job requirements (date, time, hourly rate, description), and communicate with assigned Dishies. You agree to:

  • Provide accurate job descriptions and requirements

  • Maintain a valid payment method on file

  • Confirm job completion when work is satisfactorily performed

Dishies

As a Dishie, you are an independent contractor providing dishwashing services. You may browse available jobs, accept jobs, and complete assigned work. You agree to:

  • Arrive at the job location on time as specified

  • Complete the work to the restaurant's satisfaction

  • Maintain accurate profile information

  • Set up a Stripe Connect Express account for payment processing

5. Job Posting and Acceptance

When a restaurant posts a job on the Platform, nearby Dishies receive notifications. Jobs are assigned on a first-come, first-served basis - the first Dishie to accept a job is automatically assigned, and the job becomes unavailable to other Dishies.

By accepting a job, the Dishie commits to arriving at the specified location and time and completing the work as described. By posting a job, the restaurant commits to paying the agreed-upon rate upon satisfactory completion of the work.

Either party may cancel a job before it begins, subject to any cancellation policies that may be implemented by the Platform.

6. Payment Terms

All payments are processed through Stripe. Restaurants must maintain a valid payment method on file. Payment authorization occurs when a job is posted, and payment is captured after job completion is confirmed by the restaurant.

The Platform charges a service fee of 20% of the total job payment. The remaining 80% is paid to the Dishie. Fees are automatically calculated and deducted during payment processing.

Dishies must set up a Stripe Connect Express account to receive payments. Withdrawals to bank accounts are subject to Stripe's processing times and any applicable fees from your financial institution.

All payments are final except in cases of documented no-shows or disputes handled according to our dispute resolution process.

7. No-Show Policy

If a Dishie fails to arrive at the job location at the specified time without prior cancellation, the restaurant may mark the job as a "No Show." In such cases:

  • The payment authorization is cancelled and no charge is processed

  • The Dishie may receive a strike on their account

  • Repeated no-shows may result in account suspension or termination

8. In-App Communication

The Platform provides in-app messaging for communication between restaurants and assigned Dishies. You agree to:

  • Use the messaging feature only for job-related communication

  • Not share personal contact information (phone numbers, email addresses) through the Platform

  • Maintain professional and respectful communication at all times

9. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws

  • Post false, misleading, or fraudulent job listings or profiles

  • Harass, abuse, or harm other users

  • Interfere with or disrupt the Service or servers

  • Attempt to circumvent payment processing or fees

  • Use automated systems to access the Service without authorization

10. Intellectual Property

The Service and its original content, features, and functionality are owned by DishiDash and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute any content you submit through the Platform, solely for the purpose of providing and improving the Service.

11. Independent Contractor Relationship

Dishies are independent contractors, not employees, partners, or agents of DishiDash or the restaurants. As an independent contractor, each Dishie:

  • Is responsible for their own taxes and insurance

  • Determines their own schedule and availability

  • Provides their own tools and equipment unless otherwise specified

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We are not responsible for the quality, safety, or legality of services provided by Dishies, or the accuracy of information provided by restaurants or Dishies. We do not guarantee job completion or the availability of Dishies for any particular job.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DishiDash SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

14. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us or through the app settings. Upon termination, your right to use the Service will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on the Platform and updating the "Last Updated" date.

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modifications, you must stop using the Service.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DishiDash operates, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration or in the courts of the appropriate jurisdiction, as determined by applicable law.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DishiDash regarding the use of the Service and supersede all prior agreements and understandings.
